1. About Us
Koala Classics is a registered business name operated by Garry J Ryan (ABN 29 820 791 391), based in Queensland, Australia. You can contact us at: Admin@koalaclassics.com.
Koala Classics provides vehicle export facilitation services. We are not a vehicle dealer, broker, or reseller, and we do not take ownership or possession of vehicles unless expressly agreed in writing.
2. Acceptance of Terms
By accessing this website or using our services, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.
3. Nature of Our Services
Koala Classics provides:
- Vehicle sourcing assistance
- Introductions between buyers and sellers
- Coordination of independent escrow services to protect buyer funds
- Coordination of inspections, transport, and export logistics from Australia
- General guidance on export from Australia and import requirements in the destination country
Koala Classics does not:
- Buy or sell vehicles
- Act as an agent for any party unless expressly agreed in writing
- Hold, receive, or process buyer purchase funds (this is done by independent escrow)
- Guarantee any transaction outcome
4. Escrow-Protected Payment Process
Koala Classics does not receive, hold, or process vehicle purchase payments. All vehicle purchase payments are made via an independent escrow service that we help coordinate. The escrow service holds buyer funds safely until the buyer verifies receipt and condition of the vehicle, then releases payment to the seller. This protects both the buyer and seller.
5. Buyer Responsibility
Buyers are solely responsible for:
- Verifying the identity and legitimacy of the seller
- Confirming the condition, authenticity, and suitability of the vehicle
- Ensuring compliance with import laws in their destination country
- Obtaining independent inspections where required
Koala Classics may assist with coordination but does not assume responsibility for these matters.
6. Third-Party Services
Koala Classics may assist in coordinating third-party services, including:
- Independent escrow services (to hold and manage buyer funds)
- Vehicle inspectors
- Transport providers and freight forwarders
- Customs brokers and compliance providers
These providers operate independently and are engaged at the buyer's direction. Koala Classics is not responsible for the acts, omissions, delays, or performance of third-party providers, including escrow services. Escrow providers maintain their own terms and privacy policies.
7. Fees and Payment
Service fees will be outlined prior to engagement. Unless otherwise agreed in writing:
- Fees are payable as specified in your invoice or agreement
- Third-party costs are separate and payable directly to those providers
- Quotes are estimates only and may vary
8. Cancellations and Refunds
Refunds are handled as follows:
- Prior to service commencement: full or partial refund may be provided at our discretion
- After work has commenced: fees may be partially refundable based on work completed
- After substantial completion: fees are non-refundable
Nothing in this clause limits your rights under applicable consumer law.
9. No Guarantees or Warranties
To the maximum extent permitted by law, Koala Classics does not guarantee vehicle condition, quality, or authenticity; the accuracy or conduct of sellers; shipping timelines or logistics outcomes; or import approval or eligibility in any country. All information provided is general in nature and should not be relied upon as a substitute for independent advice.
10. Limitation of Liability
To the maximum extent permitted by law, Koala Classics is not liable for loss arising from transactions between buyers and sellers, loss caused by third-party providers, or indirect or consequential losses. Where liability cannot be excluded, it is limited to the amount paid for our services, to the extent permitted by law.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law. Where required, services will be provided with due care and skill.
12. Website Information
Information on this website is provided for general guidance only and may change without notice. We do not warrant the accuracy, completeness, or reliability of website content.
13. Privacy
We handle personal information in accordance with our Privacy Policy.
14. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the jurisdiction of the courts of Queensland.
15. Changes to Terms
We may update these Terms from time to time. Updated Terms will take effect upon publication on our website.
